1. Acceptance of Terms

By accessing or using MyCityByt.com ("Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms apply to all users of the Platform, including buyers, sellers, and visitors. We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. About the Platform

MyCityByt.com is an online marketplace that connects home chefs and cloud kitchens ("Sellers") with food buyers ("Buyers") in Hyderabad, Telangana. The Platform facilitates pre-order meal bookings, slot-based delivery or pickup, and payment processing.

MyCityByt.com is a technology intermediary and is not directly involved in the preparation, packaging, or delivery of food. Sellers are independent entities responsible for their food and services.

3. User Accounts

3.1 Registration

To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at legal@smartkitchen.in if you suspect unauthorised access to your account.

3.3 Eligibility

You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement.

4. Buyer Obligations

• Provide accurate delivery address and contact information.
• Place orders before the slot cutoff time.
• Make timely payment for all orders placed.
• Treat sellers and delivery personnel with respect.
• Report genuine issues with orders within 24 hours of the scheduled delivery/pickup time.

5. Seller Obligations

• Maintain valid FSSAI registration and comply with all applicable food safety laws.
• Prepare food in hygienic conditions and list accurate ingredients and allergen information.
• Fulfil confirmed orders on time and as described.
• Maintain accurate stock/slot availability to avoid over-booking.
• Pay applicable platform commission as per the subscribed plan.
• Not list any prohibited, restricted, or adulterated food items.

6. Orders & Payments

6.1 Order Placement

Orders are confirmed only upon successful payment. Pre-orders must be placed before the seller's specified cutoff time for each meal slot.

6.2 Pricing

All prices displayed are inclusive of applicable GST unless stated otherwise. Delivery charges, if any, are shown at checkout. MyCityByt.com reserves the right to change pricing at any time.

6.3 Payment Processing

Payments are processed through Razorpay. By making a payment, you agree to Razorpay's terms of service. MyCityByt.com does not store your card or bank details.

6.4 Platform Commission

Sellers agree to pay a commission on each completed order as defined in their subscription plan. Payouts to sellers are processed within 2 business days of a payout request, subject to review.

7. Cancellations & Refunds

Please refer to our Refund Policy for detailed information on cancellations, refunds, and dispute resolution. Key points:

• Buyers may cancel orders before the seller's cutoff time for a full refund.
• Orders cancelled after the cutoff time are non-refundable.
• In case of a seller failing to fulfil a confirmed order, a full refund will be issued.
• Refunds are processed to the original payment method within 5–7 business days.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Post false, misleading, or fraudulent information.
• Attempt to gain unauthorised access to any part of the Platform.
• Interfere with the Platform's operation, servers, or networks.
• Scrape, crawl, or extract data from the Platform without permission.
• Harass, abuse, or harm other users.
• Create multiple accounts to circumvent restrictions.

9. Intellectual Property

All content on the Platform, including logos, text, graphics, software, and trademarks, is the property of MyCityByt.com or its licensors and is protected by applicable intellectual property laws.

Sellers grant MyCityByt.com a non-exclusive, royalty-free licence to display their menu content, images, and store information on the Platform for the purpose of promoting their products.

10. Limitation of Liability

To the maximum extent permitted by law, MyCityByt.com shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to food quality issues, delivery delays, or order disputes between buyers and sellers.

Our total liability in any matter arising from these Terms shall not exceed the amount you paid for the specific order giving rise to the claim.

11. Termination

MyCityByt.com reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, third parties, or the Platform.

You may deactivate your account at any time by contacting us at legal@smartkitchen.in.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
